Banned for stealing

Banned for stealing eh, from a player who no longer plays...

Okay I get it, this is an appeal I will ignore all chests that don't belong to me in future even those owned by players who no longer play.

'Stealing' is bad.. I'm bad..

Firstly you stole.
Secondly the player that you stole from is not a player who doesn't go on the server anymore. How would you know? You'd just joined.
Thirdly, I'm not inclined to lift the ban, as you have not put forward any good justification.

The ban remains in place.

1) Prove that I had the intent to permanently deprive the owner of the item/items or its/there use.

The actus reus of theft is usually defined as an unauthorized taking, keeping or using of another's property which must be accompanied by a mens rea of dishonesty and/or the intent to permanently deprive the owner or the person with rightful possession of that property or its use.

For example, if X goes to a restaurant and, by mistake, takes Y's scarf instead of her own, she has physically deprived Y of the use of the property (which is the actus reus) but the mistake prevents X from forming the mens rea (i.e., because she believes that she is the owner, she is not dishonest and does not intend to deprive the "owner" of it) so no crime has been committed at this point. But if she realises the mistake when she gets home and could return the scarf to Y, she will steal the scarf if she dishonestly keeps it (see theft by finding). Note that there may be civil liability for the torts of trespass to chattels or conversion in either eventuality.

2) Prove that I knew the player was still active and that I took the item or items in question without first establishing if the player was active and had ownership.

You say I stole, I say I didn't believe the item to belong to any persons active on the server, so I'm accused of Theft by finding', so perhaps you are implying that I took the item or items and never took the precautionary measures to ensure the item or items were not owned by anybody, the stick method of right clicking is the flaw in the server's design as it falsely identifies areas of that map that are owned and not owned. If this is the only method of establish ownership then I took all precautionary measures to do so prior to taking the item or items.

3) You have not put forward any good justification as to why I should be banned other than 'stealing', you have failed to give an account of the item or items I am accused of stealing nor the player I am accused of stealing from. You have failed to provide any evidence to back up your claim and your egocentric response clearly shows you have little interest in resolving this issue and finding the truth of the situation.

To be honest, you shouldn't respond to this as it will only give me more reason to return, I'd rather forget I'd even been playing on this server if I am going to be treated like a real life criminal for playing the game as it was intended.

I wish you the best of luck growing your community and hope that you will think more about the way you respond to players in future.

P.S. let this be a red flag to other players that have been banned, this server isn't worth the effort.

We are very strict on our rules. We do not ban unjustly, and are forgiving in circumstances of mistaken wrong-doing; having un-banned a player for mistaking another players' rail for their friends and thus removing it under the mistaken notion that they had permission to do so. However, that is not so in your case.

You found a house, with a player's name on a sign above the door. You entered this house, and found a chest; again the chest had ''<player>'s hard earned goodies' on a sign above it. By my understanding, you also used a stick to right-click inside the house. This presented you with the message 'That block has been claimed by <player>". So, we have three instances of proof you were presented with to establish ownership of the chests and thus the items within the chest.

Based on the above, you KNOWINGLY deprived that player of the following items:

38x Emeralds
138x Gold Ingot
164x Iron Ingot
14x Diamond
8x Coal

Your claim that the player had not played recently is not really relevant. Like your ban, their ownership remains.

The response you received from LadyBountiful would have been based on the lack of remorse for your actions evident in your 'apology'.

I recollect a different version of events. Not out of respect for you, your server or the players that play on the server but out of my own ability to know right from wrong I ignored numerous plots/houses and chests that did display a message stating that the plot was owned by a player.

You found a house, with a player's name on a sign above the door. You entered this house, and found a chest;


I have a sign outside my house too but I will never play again seeing as I am banned, how are players to know that my items are for the taking?

'This presented you with the message 'That block has been claimed by <player>".'


If I recollect correctly, players cannot open chests that are owned by other players without the player setting permission, you should be able to confirm this.

I don't remember the exact entry within the rule book but I assumed if I hadn't played in a week that the plot I had claimed would be available for any other player to claim, that assumption led me to believe that the houses that had no claims had not been playing for longer than a week or hadn't been on for an extended period of time.

I've come to the conclusion I was banned because the player was established and liked within the community as the other chests I took items from other houses has gone unnoticed.

Don't see this as an appeal any more, I couldn't give two monkeys, there are too many servers out there for me to play on for me to spend any more time here on 'Zedwork' I'm just trying to highlight the flaws in 1) your server setup and 2) the way your rules are enforced.

Good luck for the future, albeit bleak.

No, other players items are not up for grabs. Players are not allowed to decide for themselves which rules can and cannot be broken, under any circumstances. If a player is banned, their items are not for the taking. We allow at least a week, after that point players can ask a Guardian to remove their build should they wish to expand into the area. A guardian will then, if the player has not appealed or been unsuccessful in their appeal, removed the build. Occasionally, they may allow items to be removed from the chest first. To avoid any misunderstandings, we generally have a policy that banned players' items are never up for grabs.

I am aware you have taken from other chests, but I need not look into it as this one example was clear that you had stolen.

Your version of the events seem to support the timeline I gave.

The rules are not there to be broken, the claims/protection is there to give players security.

If a player did not claim a portion of their house, this does not give you permission to remove from it.

The rules stand, even if you find you can technically break them based on a badly configured claim.

I am sorry you did not read the rules thoroughly, and feel your ban is unjust. But I assure you, the rules were broken and you cannot find any loopholes in order to falsify our rules. I understand your version of the rules may make more sense to you, but you cannot decide my servers' rules, only follow them. I would advise that you adjust this thinking before moving on to another server, to avoid such a situation occurring again. Read their rules, then check with the servers' admins on your understanding of their rules before proceeding.

*is glad this person is perm banned* Can't believe they actually tried to make their theft look like it wasn't theft with a freaking Essay. O.o that thing is long! :lol: well done for sticking with it zed. :mrgreen:
